Bathu faces eviction battle over alleged rental debt
Popular South African sneaker brand Bathu is facing possible eviction from Springs Mall after the shopping centre's owners launched legal proceedings, alleging the retailer has fallen behind on its rental payments.
According to court documents obtained by Africa Daily, the application was filed by Blue Crane Eco Mall, Vukile Property Fund and F&G Investments 2, the entities that own interests in the East Rand shopping centre. Bathu and its founder, Theo Baloyi, have been named as respondents in the matter.
The landlords claim Bathu first entered into a lease agreement in February 2021 with Murinda Investments, a former shareholder in the mall, for retail space at Springs Mall. Following changes in ownership, the lease was transferred to the current property owners.
Under the initial agreement, Bathu was required to pay monthly rental of approximately R41,000, in addition to municipal charges and other operating costs. The lease commenced in March 2021 and was originally set to expire in February 2024.
The court papers indicate that Bathu later secured additional storage space at the mall through separate lease agreements and subsequently renewed its main lease. Rental obligations reportedly increased over time, with the retailer agreeing to pay more than R50,000 per month under a renewed agreement signed in July 2025.
The landlords allege that Bathu breached the lease terms by failing to keep up with its monthly payments.
"The first defendant breached the terms of the lease agreement by failing to make payment as agreed of the monthly rental and charges and is presently in arrears in the amount/balance of R263,191.94," the court papers state, according to Africa Daily.
The mall owners further contend that despite repeated demands for payment, the outstanding amount remains unpaid. They claim the alleged breach and subsequent cancellation of the lease have resulted in damages exceeding R1 million.
"This total amount of R1,091,443.18 represents the fair and reasonable value of damages suffered by the lessor as a result of the early termination of the lease agreement," the court papers reportedly state.
As part of the legal action, the property owners are seeking an order compelling Bathu to vacate the premises immediately.
The application asks for the "ejectment, forthwith, of the first defendant and anyone claiming occupation through the first defendant from the commercial leased premises," according to the documents.
Baloyi has disputed the allegations and said he was unaware that legal proceedings had been instituted against him and Bathu and that the company was up to date with its rental obligations and denied that it was in arrears.
