When even law students start questioning the CJI, something is seriously broken.

More than 450 NALSAR students have reportedly opposed inviting CJI Surya Kant as the chief guest at their convocation.

These aren’t random protesters. They are law students—the very people being trained to enter the justice system.

For years, ordinary citizens have raised questions about judicial accountability, transparency, double standards and corruption.

Now the questions are reaching the classrooms of tomorrow’s lawyers.

When even students who are supposed to look up to the judiciary are losing faith in it, the problem is no longer just public perception.

It is a crisis of credibility.

A judiciary that refuses to introspect should not be surprised when citizens stop trusting it.

This is a big shame in judiciary that in the corridors of the courts this is happening.

The courts are becoming extortion agents where men are being beaten up if they question the system.

The Wife here along with goons are beating a husband in court premises .
And police and crpf is unable to protect him

Why?

This is the real double standard.

Women can abuse, mock, dig personal life, call names — all under the banner of “speaking up.”

The decision of the SC to protect the child's rights and to not let the child face the stigma of being called illegitimate, comes on the expense of justice for the husband.

Two articles of the Constitution are being violated here.

1. Article 21 (Right to Life and Personal Liberty): Forcing a man to maintain a child that is not biologically his, and denying him the right to establish the biological truth (often by refusing DNA tests), violates his right to live with dignity and his right to privacy.

2. Article 14 (Right to Equality before the Law): It can be argued that the law discriminates against the husband by placing an absolute burden on him while shielding the wife's infidelity and the actual biological father from consequence.

Now, I am sure, India is not the only country where this paternity fraud happens. So, how do the other countries deal with it?

1. In the USA, if a husband suspects the child is not his, he can petition for a court-ordered DNA test. If the test proves he is not the father, his legal and financial obligations (like child support) are ended. However, there is usually a strict statute of limitations (e.g., he must challenge paternity within 2 to 5 years of the child's birth, depending on the state).

2. In the UK, the husband is presumed the father and put on the birth certificate. However, he can dispute this. The Child Maintenance Service or the family courts will accept DNA evidence. If he is proven not to be the biological father, his financial liability ends.

3. In France, a man must go through a judge to legally order a DNA test. If he successfully contests it (usually within a 10-year window), the legal ties and financial responsibilities are broken.

So, you see, there are better laws which can be adopted. What is truly at stake is the social stigma the child faces of being called an illegitimate. But that can be solved, without violating Article 21 for both the husband and the child.

So, this is how it should be solved in India.

1. DNA Tests should be allowed by court, in all such cases (have a satuatory limitation, that it can be done only till 5 years of the child's age). Why to have unscientific conclusions when there is medical test available? Update the law.

2. Even if DNA test confirms paternity fraud, the court should allow the child to carry the surname of the husband, so that the child is socially legitimate. Thus Article 21 for child is secured.

3. But, the court then should grant divorce to the husband, citing cruelty (adultery & paternity fraud), and husband should not be made to pay any child support. The financial obligation of the husband towards the child and wife should end.

3. The lover, who is the biological father of the child, should be mandated by the court to pay the child support. This would act like a penalty and discourage paternity frauds in the society.
