On September 15, a unanimous three-judge panel of the Eighth Circuit Court of Appeals reversed the dismissal of his First Amendment lawsuit against the Minnesota Board of Medical Practice — ruling he deserves his day in court.

The backstory: from the start of COVID through mid-2022, the Board received 18 complaints about Dr. Jensen. The objection was almost always the same — "spreading misinformation" — for opposing vaccine mandates and school and business closures. Those complaints triggered four investigations. He spent years and a fortune defending his license. All four investigations closed. Zero discipline. Zero patients harmed.

As Judge Stras wrote for the unanimous panel: "Years of investigations by the Minnesota Board of Medical Practice caused Dr. Scott Jensen to speak less and spend more. Either would be enough for a court to hear his case, so we reverse."

Let that sink in. A state licensing board used years of investigations to punish a doctor for his political speech — and a federal appeals court just said: not so fast.

The case now goes back to the district court for a ruling on the merits. But this is a win — for patients, for medical freedom, and for the free speech of every Minnesotan who dares to question the consensus.
When doctors are afraid to speak, patients lose.

John Nagel, the Republican nominee running against Ilhan Omar for the U.S. House of Representatives in Minnesota’s Fifth District, spoke with Liz Collin on her podcast about the raid of Omar's home in Washington, D.C. and other controversies, including her citizenship status.

Nagel, a former field lieutenant with the Minnesota State Patrol who retired after a 30-year law enforcement career, also spoke about the investigation.

"If it were me, I would want this investigated, cleared up, and then move on. However, they're not doing that," Nagel said in speaking about the response from Omar's team.

"And that to me says a lot because if you're not willing to have people go into your past, then there must be something there," Nagel said.
