Everyone I’ve talked to who knows Brendan Sorsby speaks highly of him as a guy you’d want as the face of your program. I have friends who’ve gone down some dark holes from gambling too, and I know how easy it is. I’m sympathetic to all of it. But if the NCAA can’t police gambling on your own school… we’re done here. There’s no chance any rules will ever matter if there’s a friendly local judge or enough $$ at stake.
Big loss for the NCAA in the Sorsby case. The NCAA will continue to lose cases when it acts arbitrarily and capriciously. This isn’t an antitrust case. It’s based on breach of contract, breach of duty of good faith and fair dealing, and breach of fiduciary duty. An antitrust exemption won’t excuse the NCAA from the inequitable treatment of athletes.
As disastrous a ruling as there has ever been in modern sports. The pathway is now clear: gamble as much as you like, including on your own team and hope you are--or get--good enough that you can lawyer up down the line. A much bigger disaster than anything with NIL or portal.
