Court records show the 30-year-old has been in and out of the criminal justice system even his father sought a domestic violence restraining order against him.

Last fall, he was charged with threatening public employees, battery, obstruction and resisting a peace officer, and causing injury to an elder or dependent adult.

Court records also show prior arrests for petty theft, trespassing, vandalism and placing bodily fluids on an officer while in jail.

Now he is accused of starting a fire that threatened homes and forced evacuations.

A 68-year-old California retiree was stabbed to death outside his Bay Area home, allegedly by an illegal immigrant who had been released from jail just one day earlier.

Police say Todd Stewart encountered 36-year-old Venezuelan national Marcos Arrante Valdez during an alleged burglary. According to the report, Valdez had two prior burglary cases and had been released by the courts twice.

DHS is now calling on California officials to keep Valdez in custody and turn him over to ICE. Valdez is expected to be arraigned this afternoon.
