Charter of Rights s14 'right to an interpreter' in #criminallaw trial. Unanimous Ontario appeal court ordered new trial in 2nd degree murder case because the accused received translation in 'wrong' language. R v Chen ONCA https://t.co/H3aZ0AePRl

2 guns, 4 ppl. 1 on someone. Defence lawyers know knowledge & control is REQUIRED to find all 4 guilty at trial. If a gun is hidden in a console/glove compartment, it is difficult to prove poss'n for those found emptyhanded. Cops are counting on the public not understanding this.
New: Crown stays charges against 5 of 8 people charged in chaotic shootout outside Queen St. W. recording studio last month https://t.co/aWLRQl2uTs via @torontostar
R. v. Keizer, 2024 ONCA 815: A potentially scandalous case. A man agreed to a plea bargain when the Crown advised that an officer could not attend the trial date because of a medical issue. But that wasn't accurate.

We need peremptory challenges back! Juror giving a Challenge Coin to the investigating officer with a “Thank you” card???!!! @len_1980 - The current gov has made our system more vulnerable to wrongful convictions by removing procedural safeguards. https://t.co/ZLrdSbzQdj
They claimed traffic congestion was caused by trains, street cars, wide sidewalks, urban neighborhoods... So we destroyed all those things to "solve traffic", yet traffic is worse than ever. Now they're blaming bike lanes? It has always just been cars - cars cause congestion.
I'm really tired of the dishonest conversations about bail. Jails are not empty, they are overcrowded! Over 70% of people in remand centres are innocent. Cells are triple bunked where 1 person sleeps on the floor. Politicians are knowingly being dishonest for votes. End rant.
We are almost sold out. Register asap. If you’re looking to share a room or car pool with someone to Muskoka, email [email protected] so we can try to assist.
Now we are suddenly in a manufactured moral panic about car theft.
Each season a new crime is at the centre of attention, every time more jail time is on the agenda, and it never works.
Stiffer sentences for car theft? So maybe mandatory minimum sentences (MMS) are in the news AGAIN. Aside from reasons related to Charter values, let me tell you why YOU the TAXPAYER should be opposed to mandatory minimum sentences. 1/6
Three important points to make here:
1) It is extremely misleading to try to draw conclusions from court data for 2020-2022. During the COVID years, courts were mostly shut down and (relatively) few trials actually proceeded. Many charges were withdrawn or resolved by pleas to other charges because of these enormous strains on resources. Once the backlog begins to clear (if ever), we'll be able to look at multi year trends again.
2) Someone who is "probably" guilty, is to be found "not guilty". All western legal systems require proof beyond a reasonable doubt, or something similar, to convict. The justice system actually works as designed if someone who is "only" probably guilty is acquitted. This is not a civil proceeding with a lower standard of proof
3) Some provinces with a higher percentage of guilty findings that Ontario have a robust pre-charge screening process, which keeps cases seen to have a low probability of success out of the system. We don't have that in Ontario, so these prosecutions (which are not brought in these other provinces) likely contribute to our higher non-conviction rate.
