Gaza: International Law Question of the Day #1
After the human tragedy in northern Gaza yesterday, where more than 100 people died, trying to get food from an aid convoy, I was asked in a media background briefing the following question:
Can it be that a State
- has absolute control over, and blocks access to a territory a tenth of the size of Greater London
- has several thousand troops in that territory
- has military checkpoints throughout the territory
- has dislodged the local administration of the territory
- has destroyed the infrastructure and the majority of civilian dwellings in the territory
- has displaced large parts of the people in the territory
- has contributed to food shortages of the population remaining in the territory
and has ABSOLUTELY NO OBLIGATIONS UNDER INTERNATOINAL LAW with regard to the population in the territory?
Short answer: NO
- even a State lawfully exercising its right to self-defence against a terrorist organisation is bound by the laws of war
- under the laws of war, Israel is the Occupying Power in northern Gaza, having substituted its own authority for that of Hamas (according to the ICJ neither the justification for the occupation, nor whether Israel has established a structured military administration of the territory occupied is of any relevance)
- the Occupying Power is under an obligation “to take all the measures in its power to restore, and ensure, as far as possible, public order and safety” (Art. 43 HRLW)
- the Occupying Power “has the duty of ensuring the food and medical supplies of the population” (Art. 55 GCIV)
- the Occupying Power “has the duty of ensuring and maintaining … the medical and hospital establishments and services, public health and hygiene in the occupied territory” (Art. 56 GCIV)
- the Occupying Power “shall agree to relief schemes” on behalf of the population of the occupied territory and “shall facilitate them by all the means at its disposal” (Art. 59 GCI)
- relief consignments by humanitarian organisations or other States ”shall in no way relieve the Occupying Power of any of its responsibilities under Articles 55, 56 and 59” (Art. 60 GCIV)
Both the Hague Rules on Land Warfare (HRLW) and the Fourth Geneva Convention (GCIV) are reflective of customary international law binding on Israel. Israel cannot escape its obligations under the laws of war by abandoning Gaza to lawlessness – if you break it, you own it!
Ireland 🇮🇪 condemns Israel for undermining the work of UNRWA, donates an additional €20ml and calls on all countries, including the USA 🇺🇸 to resume funding immediately.

The level of humanitarian assistance that has been allowed into Gaza up to this point is completely inadequate.
I reiterate my call for an immediate humanitarian ceasefire & for unimpeded access to be granted, consistently, safely & to scale.
