A system that allows judge-shopping isn’t good for anyone—especially the judiciary. It’s within our means to reform, even in these partisan times. Make the effective date prospective, so neither side will know who in the future might or might not benefit from a more fair system.
This is so important. Given Justice Kagan's comments too on nationwide injunctions last week and where Gorsuch and Thomas are, there should be some bipartisan energy in Congress behind making system for seeking nationwide injunctions more rational and discourage forum shopping.
