Imagine Julius Malema as the President of the Republic of South Africa, then think about all the allegations levelled against him. Lastly, imagine the types of officials he’d appoint in his cabinet, the judiciary, the peace and security cluster. We can be a failed state overnight here! 🤡🚩
We are constantly told to "follow the law" and direct our concerns to government yet the very same people making that argument routinely justify illegal stay by claiming government is too slow, too incompetent, too inefficient and too dysfunctional to process visas properly.
Which is it?
If government incompetence is a valid excuse for ignoring immigration laws, then don't lecture South Africans about being patient while that same incompetent government fails to enforce those laws. You cannot use state failure as a defence for illegality on Monday and then demand unwavering faith in the states processes on Tuesday. We are told that people become illegal because the system "forced" them to. By that logic South Africans are equally justified in taking matters into their own hands when the state repeatedly fails to address illegal immigration.
Of course, the correct answer is that nobody should take the law into their own hands but that principle must apply equally to everyone. The reality is simple, if you believe in the rule of law, then wait for your visa, comply with the conditions of your permit and respect the country's immigration laws. And if your argument is that inefficiency is a legitimate reason to disregard the law and remain illegal in the country then you have already forfeited the right to demand legalism from anyone. You cannot demand legalism from South Africans while excusing your illegality.
