They declared all positions vacant with a quorum of 12 legally backed up by the Senate Rules, the Constitution, SC jurisprudence, and Senate practice.
Why should Legarda know this?
It’s because in May 2015 when three (3) of their fellow Senators were arrested for plunder and she was abroad on an official trip, they used a quorum of 12 out of 17 available Senators to conduct business.

What happened today was a clear abandonment of responsibility, a dereliction of duty, and a blatant disregard of the rules that govern this institution, because the Senate cannot be made to stop working simply because its presiding officer refuses to lead.
Under Rule XIV, Sec. 41 of the Rules of the Senate, the Senate President may postpone the holding of the session AFTER consultation with the Majority Leader AND the Minority Leader. That rule was violated. This is not merely a procedural lapse—it is a direct violation of the Rules of the Senate and a serious disrespect for the institution and the Filipino people.
Senate President Alan Peter Cayetano SHOULD RESIGN as he has shown that he cannot function as the leader of the Senate.

More than a century ago, at the Tejeros Convention that would shape the first Philippine revolutionary government, Daniel Tirona publicly questioned Andres Bonifacio’s election as Director of the Interior on the ground that Bonifacio was not a lawyer. As if a rigged election (or a lutong macau!) favoring Emilio Aguinaldo was not enough, Tirona still felt compelled to shame and completely marginalize Bonifacio so elite power could fully take over the revolution and displace the more radical Katipunan.
And while Bonifacio’s courage, leadership, and sacrifice continues to inspire Filipinos today, history would remember Tirona unkindly. During the Philippine-American War, he surrendered to American forces— without firing a single shot— despite commanding one of the better-equipped units. He also ended up as a servant of the American officer to whom he had surrendered for a time, cleaning his shoes and serving his meals.
A very different century, but nonetheless a familiar habit for those whose loyalty isn’t to the Filipinos. Then, the shameful cowardice of Tirona is finding powerful patrons in Aguinaldo and then the Americans. Today, some politicians seem to find remarkable comfort carrying water for interests far closer to Beijing and the main in jail in The Hague than to the Philippines.
‘SHROUDS HIMSELF IN DARKNESS’: ATENEO LAW STUDENTS TAKE SWIPE AT CAYETANO
The Ateneo Law School Student Council on May 21 criticized Senate President Alan Peter Cayetano over the Senate’s handling of issues involving Sen. Ronald “Bato” dela Rosa and the International Criminal Court.
In a statement, the student council said Cayetano, an Ateneo alumnus, “fell short of the ethical leadership expected of him as an Atenean” and accused the Senate of placing “institutional solidarity at the expense of institutional integrity.”
“There is no expression of the virtue of Lux in Domino when an Atenean senator shrouds himself in darkness,” the Ateneo Law School Student Council said of Sen. Cayetano.
The group also urged the Senate not to become a “sanctuary against accountability,” saying lawmakers should uphold constitutional principles instead of shielding colleagues facing serious allegations.
The student council likewise called on dela Rosa to “cease his evasion of international legal processes” and submit himself to lawful accountability mechanisms.
