2/ If China sues, it's Canadian taxpayers who foot the bill — not the province, not the company whose policy triggered the claim. A carbon tax, a zoning change, or any regulation that cuts the value of a Chinese-owned Canadian asset can trigger a claim. Any award or settlement comes from federal coffers and is decided by an international arbitration panel outside Canadian courts.
3/ The proceedings can be kept closed at the request of the government being sued. Awards are only guaranteed to become public once a case reaches a final ruling — if Canada settles or pays out before that point, the amount, the company, and the existence of the dispute need not be disclosed at all.
