Senator Rand Paul proposes to pass a constitutional amendment to end Birthright Citizenship.
Steep hurdle… To pass a constitutional amendment ending/modifying birthright citizenship:
• Congress route: 2/3 House (~290 votes) + 2/3 Senate (67 votes), then ratification by 38 states. President has no role.
• Alternative: 34 states call a convention, then 38 ratify.
Realistic? Nah… not right now. Not even after midterms. Best route is legislation… unless military gets involved.
🔻 Possible legislative “band-aids” (short of a constitutional amendment)
Birthright Citizenship Act of 2025 (H.R. 569 / S. 304): Amends the Immigration and Nationality Act (8 U.S.C. § 1401) to redefine “subject to the jurisdiction thereof.” Automatic U.S. citizenship at birth would apply only if at least one parent is a U.S. citizen/national, lawful permanent resident (green card holder), or active-duty U.S. military member.
Documentation and agency restrictions: Direct federal agencies (State Dept, DHS, SSA) not to issue passports, Social Security numbers, or other citizenship documents, or to reject state-issued ones, for children of undocumented parents or temporary visa holders.
• Verification and reporting requirements: Mandate hospitals/states to collect and verify parental immigration status for birth records; require reporting of births to non-permanent residents; or tie SSN/passport issuance to proof of qualifying parental status.
• Funding riders or administrative directives: Use appropriations bills to restrict agency funding or require stricter enforcement/interpretation of existing rules around citizenship claims and birth tourism.
All of these possible routes will all most certainly be met with court challenges.. and unconstitutional.
Funny how the 14th amendment itself is unconstitutional.. and trying to overturn it is unconstitutional.
