The conclusion that Dr Cartland represents a safeguarding risk to vulnerable adults and children is fundamentally misconceived.

The evidence relied upon does not establish a proper or rational connection between Dr Cartland’s conduct and any actual or prospective risk of harm to a child or vulnerable adult. In particular, his provision of letters supporting individuals who wished to exercise their right to refuse a COVID-19 vaccination cannot, without more, establish that he presents a safeguarding risk to children or vulnerable adults.

The purpose of those letters was to support individuals who had made their own decision concerning a medical intervention and wished to retain the ability to travel abroad, including to visit seriously ill or dying relatives. The underlying issue was patient autonomy, informed consent and the right of an individual to refuse medical treatment. Supporting an adult’s exercise of bodily autonomy is conceptually and factually very different from harming, exploiting, coercing or placing a child or vulnerable adult at risk.

The crucial question for a safeguarding assessment is therefore not whether the decision-maker agrees with Dr Cartland’s views concerning COVID-19 vaccination. It is whether there is credible evidence that his conduct demonstrates that he is likely to harm, or place at risk of harm, children or adults at risk in the context of football or other regulated activity.

No such evidential nexus has been identified. There is no suggestion that Dr Cartland harmed a child or vulnerable adult, attempted to do so, or that any child or vulnerable adult was the subject of the conduct relied upon in reaching the safeguarding conclusion.

It is particularly important that a distinction is maintained between professional or regulatory misconduct and safeguarding risk. A finding that conduct was inappropriate, unprofessional, dishonest or otherwise contrary to professional standards does not automatically establish that the individual presents a safeguarding risk to children or vulnerable adults. There must be a further evidence-based assessment of the nature of the conduct, the circumstances in which it occurred, the relevance of that conduct to the proposed role, and the likelihood of future harm.

The conclusion should therefore be reconsidered on the basis of the actual safeguarding evidence rather than by treating disagreement with COVID-19 vaccination policy, or support for an individual's refusal of medical treatment, as evidence of a propensity to harm vulnerable people.

In short, the assessment appears to conflate disagreement with a particular medical or regulatory position with safeguarding risk. Those are not synonymous. A safeguarding restriction of this seriousness requires a demonstrable and proportionate connection between the conduct relied upon and a genuine prospective risk to the particular vulnerable groups said to require protection.
