I haven’t read the opinion or dissent yet. I don’t want to until Ithink about the issue untouched by the facts of the case. I’m curious for your opinion.
My initial thought is that the majority is right. The defendant is entitled to a trial by a jury of his peers. I believe that in a criminal trial a judge can overrule a jury verdict and enter a judgement of acquittal. But a judge can never overrule a jury and enter a judgement of guilty.
I see two problems with allowing improper evidence and then having the guilty verdict stand.
First, I think it’s improper for Alito to conclude that there is overwhelming evidence of guilt. That’s the jury job. Not the judges. The judge can rule that there is insufficient evidence to find the defendant guilty, but not the other way around. That’s essentially what Alito is doing here. The jury decides when the reasonable doubt threshold is passed, not Alito. So it’s improper for him to opine and say the line was crossed.
Second, permitting improper evidence taints the entire process. Confidence in the system is of paramount importance. For example, judges don’t recuse themselves for conflict of interest. They recuse themselves for appearance of conflict of interest. (Regardless of whether the conflict is real or not). The public must have confidence. If you permit improper evidence then reasonable people may question the jury’s verdict. Additionally, reasonable people might question whether prosecutors play a gain and push the envelope.

Every black (and mother of every color) should tell her son not to bring a knife to a track meet. Every mother should tell their child not to go into someone else’s space when not invited. Every mother should tell when in that situation, get up and walk out instead of making threatening comments while holding a knife.
You’re supposed to be a reverend. Well if you are, preach responsibility and values. And tell you congregants not to bring knives to track meets. And tell them not to stab people who want them to leave from someplace they’re not supposed to be.
And finally, stop the race hustle bill shit. Almost everyone sees through it now. This wasn’t about race. This was about Karmelo being someplace he wasn’t supposed to be, refusing to leave when asked, and then stabbing someone and murdering them when approached. You can’t possibly be commending Karmelo’s actions.
Btw - He didn’t even take the stand to argue that he felt threatened. He didn’t even do that. So don’t give me some crap know about that when Karmelo didn’t stand up and say it.
Stop race hustling. This wasn’t about race. He stabbed someone and admitted in. He didn’t even take the stand to argue self defense. How is he going to claim it’s self defense when he won’t even get in the stand and say that he feared for his life. Karmelo had a chance to say that. But he didn’t. So he’s guilty. And you can’t put those words in his mouth now. So stop trying to make this about race when it’s about him murdering someone.
