The Judges who have ruled against the Admin. on mandatory detention for illegal aliens arrested in the interior of the country are approaching the task of understanding the meaning of Congress' language in two different statutes by viewing the language through the prism of today's facts on the ground.

The facts on the ground today are not the same as in 1996 when Congress revised the immigration statutes.

Nearly all of the Judges ruling against the Admin., including most notably Judge Bress yesterday in the Ninth Circuit, begin with a premise that -- my paraphrase not a quote that -- "Congress could not have meant the result sought by the Administration because literally millions of aliens who have been in the country for years would be subject to immediate arrest no matter the lives they have built, family members who are citizens, lack of any criminal record, blah, blah, blah."

On that premise they justify that the class of illegal aliens in the country for many years should be evaluated for release from custody -- to carry on their lives -- while their immigration proceedings continue EVEN WHEN THERE IS NO VIABLE PATH UNDER THE LAW FOR THEM BEING ALLOWED TO REMAIN IN THE UNITED STATES.

They contrast this with aliens detained at the border, who they do allow to be detained pending removal proceedings because none of the factors described above apply to them.

But in 1996 we didn't have 20+ million illegals in the country, with 10 million of them having been allowed to stream across the border with little or no vetting. AND we didn't have POLICIES and NGOs that spread them throughout the interior of the country like little Johnny Appleseeds to take root.

In the early 1990s border crossings were still almost entirely clandestine. The vast majority of immigrants were Hispanic, and a large majority remained in somewhat close proximity to the border - with a significant percentage going back and forth with some frequency.

These FACTS are largely behind the claims made by several judges, including Judge Bress yesterday, that no Administration prior to Trump 2.0 has ever asserted a statutory requirement of detention for aliens seized in the interior of the country.

That's because massive numbers of aliens weren't spread out through the entirety of the country prior to the Obama and Biden Administrations.

We now know that the Obama Admin "cooked the books" on its immigration enforcement when it included both interior removals and border "turn arounds" in one number and called them "deportations." The facts were that nearly all the "deportations" during the Obama Admin. were border turn-arounds. It did NOT enforce immigration law in the interior of the country so it never had much need to take the position the Trump 2.0 Admin. has taken.

Don't even start on the Biden Admin. They weren't interested in removing anyone for any reason -- the Biden Admin, until very late in his final year -- was operating on a de facto "open border" basis which the door in the "OPEN" position at all time.

These Judges -- including the GOP appointees -- are operating at a level of intellectual dishonesty because they know that lower courts will continue to be flooded with tens of thousands of habeas petitions if they sanction mandatory detention as the Trump Admin. is reading the statute.

The Ninth Circuit decision yesterday is really on behalf of all the district judges in the Western United States with large immigration populations where it is 100% certain there are millions of illegals. Forcing the Admin. to give them bail hearings in the immigration courts is designed to stem the flow of those petitions into the district courts.

The Trump Admin. is perfectly justified in calling this out for what it is, and continuing to arrest and detain illegal aliens until they file a habeas petition and the Immigration Courts receive an Order from a District Judge requiring them to hold a bail hearing in each individual case.

Only SCOTUS can stop this.
