People who use the line “we are not a theocracy” usually don’t understand what a theocracy actually is.

Eighteenth-century England and pre-revolutionary France were not theocracies, yet they had state churches, clerical authority, religious courts, and religious tests for office—while maintaining civil legal systems for secular matters. All those models were explicitly rejected by the American Founders.

The U.S. Constitution establishes no religion, bans religious tests for office, and places all legal authority in secular institutions. That is not an accident; it is a deliberate break from European Christian state models.

The fact that many Founders were culturally Christian—while others were deists or skeptics—does not make the state Christian. A nation is defined by its laws and institutions, not the private beliefs of its founders.

Just because the first settlers were this or that doesn’t mean much centuries later. The Roman Empire was founded by pagans who persecuted Christians, but that had no bearing centuries later.
