7歳のあいりちゃんがいた。

下校途中、たった一人で歩いていた。
それだけだった。

検察は死刑を求刑した。
判決は無期懲役だった。

父親は言った。
「あいりは2度殺された」

2005年11月22日、広島市安芸区。
「広島小1女児殺害事件」。

2005年11月22日午後3時すぎ、広島市安芸区矢野西の空き地に置いてあった段ボール箱の中に、小学1年生の女の子が意識不明の状態でいるのを近所の人が見つけた。女の子は近くに住む木下あいりちゃん（当時7歳）と判明し、死亡が確認された。死因は首を絞められたことによる窒息死だった。

あいりちゃんはどんな子だったのか。

同級生の卒業式が開かれた2011年3月18日、学校側は「同級生と一緒に卒業させてあげたい」として卒業証書と同じ文書を作成。校長が「多くの友の中で共に過ごしたことを証します」と伝えて母親に手渡した。母親は「ありがとうございます」と答え、涙ぐんだ。

同級生が卒業する日、
あいりちゃんは卒業証書を受け取れなかった。

何が起きたのか。

事件から8日後の11月30日、遺留品や目撃情報などから近くのアパートに住む当時33歳のペルー人の男（ホセ・マヌエル・トレス・ヤギ）を殺人と死体遺棄の容疑で逮捕した。

広島地検は殺人や強制わいせつ致死などの罪で起訴した。

下校途中、一人で歩いていた。
それだけが理由だった。

しかし、この事件には「もう一つの顔」がある。

加害者には前科があった。

差し戻し控訴審では、ペルーでの幼い女の子2人に対する性犯罪歴が証拠採用された。しかし広島高裁は「罪を犯したことが確実ではなく、日本国内での前歴や前科と同じように取り扱うことは許されない」として、量刑を考慮するための資料には用いないと述べた。

ペルーで幼い女の子2人への性犯罪歴があった。
それでも量刑の考慮から除外された。

裁判は複雑な経緯をたどった。裁判員裁判のモデルケースとされ、公判前整理手続が行われた。被告は法廷で意味不明の言動を繰り返し、公判が度々中断した。

検察側は死刑を求刑したが、一審広島地裁は無期懲役を言い渡した。検察と弁護側の双方が控訴するなどし、2010年8月に無期懲役が確定した。裁判は4年余りにわたった。

父・建一さんは語った。「悪魔の存在を主張し続けたことは疑問で、納得いかなかった。性犯罪というのは非常に悪質な犯罪であるので刑罰は重いんだという認識が社会に広まればいい」

ペルーでの性犯罪歴は考慮されなかった。
