1. You want to legislate sanctions against HCWs who refuse emergency care?
Let us be precise about what you are asking.
2. You are asking a doctor to manage a deteriorating trauma patient with no resuscitation bay, no functional crash trolley, no monitored bed, no oxygen point and no suction. And face criminal sanction if the outcome is poor.
3. Doctors, can you help me with the standard of care for a polytrauma patient? (RIP Kusi)
... a secured airway, two large IVs, continuous SpO₂ and cardiac monitoring, not forgetting a cross matched blood on standb & immediate surgical backup... (Clinicians in Emergency medicine can add up)
4. None of the above exists on a floor. None of those exist in a ward with 3x its capacity.
5. You cannot legislate clinical outcomes in a resource void environment.
6. A bill that punishes the clinician without resourcing the system doesn't protect patients. It just gives you someone to blame when your infrastructure kills them.
7. The problem is not the doctor at the door. The problem is the system behind the door.

A law cannot fix that. Investment can. This bill will rather punish the symptom and ignore the disease.

If something goes wrong because of that environment, the doctor will be sued.

In court, a lawyer will simply ask if that was standard practice and the doctor could be liable.
