the 5th Amendment might say “no person” gets deprived of life, liberty, or property without due process, but let’s not act like that means undocumented immigrants get the same deal as everyone else. The Supreme Court has been real clear on this. Take INS v. Lopez-Mendoza (1984)—they straight-up said the Fourth Amendment doesn’t fully apply in deportation cases, so if the government grabs evidence in a shady way, they can still use it to boot someone out. Due process? Sure, but it’s bare minimum. Then there’s Kleindienst v. Mandel (1972), where the Court was like, “Yeah, the government can keep people out, even if it steps on some rights.” Bottom line: the government’s got the power to control the border, and that means “due process” for undocumented folks isn’t the full package—it’s more like a quick hearing and a “see ya.” NO. FULL. RIGHTS. Now, don’t get me wrong—I think they’re going a bit overboard with how hard they’re pushing deportations lately, breaking up families and all that. But legally? They’re within their rights to do it.
