Interesting injunction. Sorsby’s attorneys argued three main points in their #injunction request.
1. Irreparable harm:
If Sorsby misses the 2026 season, he loses his final year of eligibility forever.
He also loses NIL opportunities and NFL development opportunities that cannot be fully compensated later with money damages.
2. Mental health/gambling addiction:
His lawyers argued that the NCAA treated a gambling addiction as a disciplinary matter rather than a medical issue. They presented evidence that he completed treatment and argued that denying him the opportunity to play could negatively affect his recovery.
3. Fairness and due process concerns:
His lawsuit alleged the #NCAA mishandled the reinstatement process and unfairly applied its rules.
The judge sided with Sorsby. I have serious disagreements with that decision, but it’s the outcome we’ve come to expect in the current NIL landscape. Until Congress grants the NCAA an antitrust exemption, or college athletes become employees and collectively bargain, there’s very little the NCAA can do to meaningfully change the situation.
