Experts say, in principle, a commission of inquiry such as the Madlanga Commission has broad powers to regulate its own proceedings and ensure witnesses comply with summonses.
If a witness repeatedly fails to appear because of illness, the Commission can:
-Request or direct that a detailed medical certificate be produced.
-Require an independent medical assessment if it is not satisfied with the evidence provided or if there are doubts about a witness’s fitness to testify.
-Postpone the testimony until the witness is medically fit.
-Consider alternative arrangements, such as taking evidence virtually or at another suitable venue, if appropriate.
Ultimately, the Commission must balance the witness’s health with its duty to complete its work efficiently.
Whether it orders an independent medical examination would depend on the circumstances and whether there is a genuine dispute about the witness’s inability to testify.
Given that several important witnesses are reportedly ill, the Commission could seek stronger medical verification if it considers it necessary to protect the integrity and progress of its proceedings.

Court has adjourned fora few minutes for Matlala to liaise with his attorney on this.
