Under Originalism, it is impossible to argue that those who drafted the Fourteenth Amendment envisioned Chinese nationals boarding jet airplanes, flying to remote United States territories, giving birth, and returning home with an American citizen.
Under Textualism, the Fourteenth Amendment extends citizenship to those born in the United States who must “reside” in one of the states, and tourists do not meet that requirement.
Even under the progressive theory of Living Constitutionalism, there is no coherent policy justification for granting American citizenship to the children of foreign nationals who enter the country solely for childbirth.
Yet the law has somehow arrived at the opposite conclusion.
