When we start to think carefully, you can really see that the “Restricted Jurisdiction” motion is full of obvious flaws.
Logically speaking, the FTX Trust’s argument simply doesn’t hold up. On July 22, they claimed that distributing digital assets to users in restricted regions might create legal risks. But as I pointed out at the time — what’s being distributed is USD, under the bankruptcy framework of cash distributions, not crypto. Otherwise, are we supposed to settle everything in coins?
Later, I filed Motion #32230, asking them to formally acknowledge that all distributions are in USD. By the October 23 hearing, under the Judge’s questioning, they finally confirmed this again.
Then they changed their story, saying the issue was not the distribution itself, but that the funds originated from cryptocurrency. But if we discuss this rationally, the U.S. Bankruptcy Code already has established compliance frameworks — including AML and OFAC sanctions — to ensure that liquidation funds are clean and lawful. There is no need to invent a brand-new procedure. A new motion doesn’t make the funds “cleaner”; it only slows down the process.
More importantly, if this new procedure isn’t about the distribution itself, then it’s a material modification of the confirmed Plan — which is not allowed. If it’s about fund compliance, it should have been addressed during the reorganization stage, not suddenly introduced during distributions.

Why I’ve been firmly opposing the Restricted Jurisdiction Motion — and what’s behind it
Because under U.S. Bankruptcy Law, once a Reorganization Plan is confirmed, the rights and obligations between the debtor and creditors are fixed.
If the debtor wants to forfeit or withhold distributions, it must file a motion to the Court — where both sides have the right to argue, and the judge decides in a transparent, public process.
But if the Restricted Jurisdiction Motion were approved, that judicial safeguard would be handed over to the Debtor’s team. Creditors would lose the right to defend themselves, and FTX could unilaterally deny payments with vague, unchecked justifications.
That’s why we must oppose the Restricted Jurisdiction Motion — to prevent them from gaining unchecked power that can easily harm creditors.
Even Judge Owens questioned:
“Other bankruptcy cases have been able to make distributions normally, so why does this Trust require an extra procedure?”
