Bringing back this clip where three lawyers discuss BTS-related trademark lawsuits, including how HYBE tried to trademark “Borahae” under its own name but was ultimately unable to register it because the term had already been established through Taehyung’s use and creation of the expression.
The case is a great reminder of why “Borahae” is so deeply associated with Taehyung and BTS’s fans.

👨🏻‍🦱Also, related to this, there is a trademark connected to BTS called “Borahae.”

👩🏻“Borahae” is actually a very beloved and meaningful word from the perspective of BTS fans. On November 13, 2016, at a fan meeting, V said the word “Borahae” for the first time. So, naturally, it really stuck in the fans’ minds. They thought, “This is V’s own word.”
Later, a brand applied to register “Borahae” as a cosmetics trademark. Naturally, the fans strongly objected, saying, “How can you take a word that V oppa created and just use it like that?”

👨🏻‍🦱In Korea, when someone applies for a trademark, the application becomes visible on a site called KIPRIS, showing that someone has filed an application and that it is currently being examined by the Korean Intellectual Property Office.
Anyone can submit an opinion regarding that application.
You can submit reasons explaining why the trademark should not be registered and why the applicant should not be allowed to obtain it.
A significant number of ARMYs submitted opinions to the Korean Intellectual Property Office, saying that this trademark should not be registered and that this person should not be allowed to own it.
They also flooded the company’s message board with complaints, saying things like, “We’re going to boycott you.”

👩🏻Eventually, the company withdrew its trademark application on its own. Then the issue was that BTS’s agency, which is now HYBE, also applied to register the trademark. They probably did so under the premise that V could use it and that the company could eventually commercialize it by holding certain rights or business rights related to it. But this, too, ultimately fell through because of opposition from the fans.

👩🏻People often think, “The artist belongs to the agency,” but strictly speaking, they are separate entities. Once an exclusive contract ends, the two sides become unrelated to each other. That’s what it means when we say that they are separate from the beginning. So the Korean Intellectual Property Office also rejected HYBE’s previous trademark application.
And the reason was actually quite simple, but also very interesting.

👩🏻The trademark “Borahae” originated from a statement made by BTS member V at a BTS fan meeting on November 13, 2016.
He explained it as meaning that, just like purple the final color of the rainbow, we should love each other until the very end. The reason for rejection was essentially that the applicant had applied for an identical or similar trademark while knowing that the term had already been used as a trademark by someone else. Therefore, it fell under the grounds for refusing trademark registration.

👨🏻‍🦱What moved me even more after seeing this case was this: How would V’s agency even know that V had said this at a fan meeting?
Of course, they wouldn’t necessarily know. But the fans provided an enormous amount of evidence. Because among ARMYs, there are obviously lawyers and patent attorneys, and they put together extremely well-supported evidence and submitted it to demonstrate why the trademark should not be registered.

👨🏻‍🦱As a result, the application was rejected at the application stage.
I think the grounds for rejection in this case are so unusual that they could almost appear in a textbook on trademark law. I had never seen grounds for rejection like this before, so in one sense, it was quite sensational. But at the same time, I found it very moving.
