RE: Request for Federal Review and Intervention Concerning Election Administration in the State of Colorado
Dear Assistant Attorney General Dhillon,
I write to you in my capacity as Chairman of the Election Commission for the Town of Castle Rock, Colorado, to bring to your immediate attention a matter of significant concern involving the administration of elections by the Colorado Secretary of State’s Office and alleged irregularities in the current gubernatorial election.
It has come to my attention, through the work of our data specialists, that the Victor Marx for Governor Campaign may have engaged in serious campaign‑finance violations commonly referred to as “smurfing.” Based on preliminary analysis, the value of the questionable contributions may reach into the hundreds of thousands of dollars.
Upon the exposure of these alleged irregularities, the Marx Campaign submitted a request to the Colorado Secretary of State seeking permission to withdraw and replace its previously filed Contributions Report. The Secretary of State’s Office subsequently permitted the campaign to submit a revised, redacted, and corrected filing.
This action, in effect, granted the campaign an opportunity to retroactively cure alleged violations after the fact. In my view, this constitutes an extraordinary and irregular administrative accommodation that undermines the integrity of the election process and creates the appearance of preferential treatment. Such actions, if left unaddressed, risk eroding public confidence in the impartial enforcement of both Colorado and federal election law.
Citizens throughout the State of Colorado have expressed deep concern regarding the fairness and lawfulness of the current election administration. Based on the circumstances described above, I respectfully request that the U.S. Department of Justice consider the following actions:
1. Federal Oversight of Colorado Elections Initiate federal review and oversight of election administration in the State of Colorado, as the Secretary of State’s Office appears unable or unwilling to enforce applicable election laws in a uniform and impartial manner.
2. Suspension of Mail‑In Balloting and Machine‑Based Voting Evaluate whether emergency federal intervention is warranted to suspend the use of mail‑in ballots and electronic voting systems in Colorado, given concerns raised by citizens regarding their reliability and vulnerability to misuse.
3. Immediate Injunctive Relief Consider seeking emergency injunctive relief to temporarily suspend the Colorado Secretary of State’s authority to administer elections until compliance with state and federal law can be assured.
The issues described herein raise profound concerns regarding equal treatment under the law, the integrity of the electoral process, and the civil rights of Colorado voters. I therefore urge the Department of Justice to review these matters with the utmost urgency.
