Laws broken:
- Fair Packaging and Labeling Act
This requires accurate net quantity declarations on consumer commodities (including packaged foods). Labels must state the net quantity in terms of weight, measure, or count (here, “cups” as a volume measure). Packages must not be misleading.
- Federal Food, Drug, and Cosmetic Act
A food is misbranded if, in package form, its label fails to bear an accurate statement of the quantity of contents in terms of weight, measure, or numerical count.
