"Gender" in the gender pay gap means sex.

There is no provision for people to opt out because they don't feel like it.

@ProfAliceS Hi Alice. Gender pay gap reporting shows the difference between the average earnings of men and women. Where an employee does not identify as either man or woman, their employer may omit them from the calculations.

Quite good but the law doesn't say this at all!

Individual case by case is an idea introduced in the guidance. It's not in the law and it's unworkable.

The Q is about whether a person's self definition should gain them the right to access spaces with the opposite sex in all of these situations.

Or whether service providers are still allowed to say

"This area is women only, that means female. Please respect that"

On "safe spaces"

In all the political word salad over the past week women's "safe spaces" keeps coming up

The Equality Act does not talk about "safe spaces"

It is about "single & separate sex services" (and sports, associations etc...)

It is not. Domestic violence refuges are just one application of single & separate sex services.

The Equality Act also covers everyday services (for both men & women) including toilets, changing rooms, dormitories, personal services, hospital wards

@gwennelsonuk @zeno001 No. Whether or not it is legitimate for it to be a single sex service. Transwomen and women are not a single sex. They are members of the opposite sex.

NB: Julius's analysis supports a straightforward implementation of single /separate sex services based on natural sex.

It suggests that the @EHRC guidance on "case by case" & allowing people in based on "the gender role they present" is wrong and not in line with EqA.
