@Johnsmithlnf5 @SheLuvBy @ABCliberator@BigBroLGND “Two guys touching you” unfortunately doesn’t warrant a stab to the chest .
And self defense is out the window when you arm yourself , taunt and provoke the person you are using self defense on . So, case closed. I don’t know why we are still arguing, your boy is locked up
I wasn't in the deliberation room, but I did read the jury instructions from the Karmelo Anthony trial. The instructions included the "provoking the difficulty" instructions.
The jury was instructed that the defendant loses self-defense protections if they provoke someone into reacting and then use that reaction as a pretext to kill them.
The evidence strongly supported that scenario, stripping Anthony of his self-defense claim.
He taunted, provoked, armed himself, and provoked further to create a situation where he could use deadly force, and that is not legal.
The only time a provocateur can regain the right is if they disengage from the situation, or voice that they want to disengage, and the other person continues to use unlawful force. That didn't happen here. Anthony never disengaged. He kept taunting until he could kill.
