I am certainly not defending any Democrat states, but I am wondering about this. It’s supposed to be a deduction at the end of the year, up to $25,000, and it only exempts tips from federal income tax. Tips are still subject to other federal taxes such as OASDI and Medicare. Businesses were given relief by the IRS for 2025 but must be compliant for 2026. The following screenshot was taken from Grok. This information matches exactly what my tax guy told me when I filed my 2025 taxes.

My tax guy explained it to me because I did DoorDash last year and wondered if I would be able to deduct tips. DoorDash doesn’t itemize tips on their earnings statements or tax documents though, so that is when he explained they didn’t have to be compliant for the 2025 tax year. I asked Grok though and here is the info it gave.
