Fund is distorting the law. Canada’s infanticide provision dates to 1948. It applies only to the mother of a child under one year, and only if her mind is disturbed by the effects of childbirth or lactation—not to ‘a parent’ and not for any reason. It was created because juries would not convict mothers of murder when the death penalty was still on the books. It is a lesser offence with a five-year maximum, not a license to kill. It does not cover older children, and it does not apply to fathers.
