The case revolves around the failure of the respondents to comply with constitutional and statutory obligations to #children in their decision to introduce new coal-fired power to generate 1500MW of electricity.
It concludes by stating that the respondents’ decisions pose a threat + actively violate the right to a safe and healthy environment. The state’s obligations require mitigating the harms + dangers associated with environmental damage, prioritising the best interests of children.

@UPChildLaw highlights the impact of the respondents’ decisions on a number of children’s constitutional rights and their failure to give due weight and consideration to the impact of their decisions on the rights of children and the interests of future generations of children.

Incorporating the UNCRC into domestic law is the most important thing we can do to protect children's rights in law, and from today it is a reality in Scotland.
Incorporation is a powerful new tool, and there is a lot of work ahead.
But today should also be about celebration.
