Les recomiendo la lectura del artículo de la jueza Adriana Orocú Chavarría, Jueza de la República de Costa Rica y Presidenta de la Asociación Costarricense de la Judicatura. Vicepresidenta de la Unión Internacional de Magistrados — IAJ-UIM: “Independencia judicial y reformas judiciales: la justicia no se fortalece intimidándola”. En este, plantea una advertencia central para cualquier proceso de reforma: no hay fortalecimiento posible de la justicia si se erosiona su independencia.

La Jueza subraya que las reformas judiciales deben orientarse a mejorar el acceso, la eficiencia y la legitimidad del sistema, pero siempre desde el respeto a la función jurisdiccional y a las garantías que protegen a jueces y juezas frente a presiones externas, interferencias o discursos de deslegitimación.

En un contexto global en el que la independencia judicial enfrenta desafíos crecientes, el artículo recuerda que debilitar las garantías institucionales no es una vía de reforma, sino de regresión democrática. La independencia judicial, no es una defensa de intereses particulares de quienes integran la judicatura: es una garantía de la ciudadanía

Como señala el propio texto: “Sin independencia, los tribunales dejan de ser espacios de garantía y se convierten en escenarios de presión. Sin independencia, las decisiones ya no responden al derecho, sino al temor. Y cuando el temor entra a la sala de audiencias, la justicia sale por la puerta trasera.”

#Perú 🇵🇪 - Junto con mi compañera Gina Romero, condenamos fervientemente la remoción del juez Oswaldo Ordóñez como represalia por su participación en una audiencia pública ante la #CIDH en noviembre del 2024.

Las y los jueces deben poder, individual y colectivamente, participar en el debate público sobre la organización, el funcionamiento y la independencia del poder judicial, de conformidad con sus deberes de discreción y responsabilidad, sin temor a presiones, medidas disuasorias o procedimientos que puedan obstaculizar el ejercicio de sus funciones institucionales. Nos preocupa que estas acciones puedan constituir un intento de castigar y silenciar al juez Ordóñez.

Noticias preocupantes de #CostaRica - Me preocupa conocer el presunto ataque contra la jueza de la República Kattia Carballo. Los ataques contra funcionarios judiciales constituyen no solo una violación de su integridad personal, sino que también amenazan la independencia judicial.

También me inquieta saber que el abuso aparentemente se produjo a raíz de declaraciones del Poder Ejecutivo, y que este ataque podría formar parte de un patrón más amplio de distintas formas de agresión contra el Poder Judicial. The #ICC ASP President, #HRW, #FoleyHoag, France and the SR on the independence of judges and lawyers, stressed the impact of sanctions and resilience of the Court.

It is urgent to remember that #sanctions impact justice officials at the national and international level. We must come together to support international officials and send a clear message: justice operators cannot be attacked for doing their job and must be protected against threats to their safety and interferences to the lawful discharge of their duties.

62% of countries saw a decline of criminal justice being free from improper government influence.
