POK कैसे बना?

15 अगस्त 1947 को देश आज़ाद हुआ तो कश्मीर के महाराजा हरि सिंह ने कश्मीर को भी आज़ाद घोषित कर दिया था।

माउण्टबेटन खुद गए थे मिलने कि किसी एक देश में मिल जाओ, लेकिन पेटदर्द के बहाने मिले ही नहीं हरि सिंह। सपना था आज़ाद 'डोगरिस्तान' बनाने का। भारत में विलय का समर्थक कर रहे शेख अब्दुल्लाह जेल में थे।

नेहरू लगातार कह रहे थे कि पाकिस्तान से हमला हो सकता है। सरदार को कई चिट्ठियाँ भी लिखी थीं जो आसानी से उपलब्ध हैं अब भी, लेकिन कश्मीर भारत का हिस्सा नहीं था तो वहाँ हरि सिंह की ही सेना थी, पटेल भी क्या कर लेते?

महाराजा मस्त थे। जम्मू-कश्मीर का संघ भी उनके साथ था। दंगों में चार लाख मुसलमान भगा दिए गए ताकि जम्मू में उनका बहुमत समाप्त हो जाए, घाटी शांत रही।

महाराजा दोनों देशों से स्टैंड स्टिल समझौता चाहते थे, पाकिस्तान ने कर लिया, भारत की नीति ऐसा कोई समझौता करने की नहीं थी।

पाकिस्तान सोच रहा था, आज नहीं कल सेब तो हमारी ही झोली में गिरेगा।

फिर ब्लॉकेड लगाया पाकिस्तान ने, कश्मीर में ज़रूरी सामान की कमी पड़ने लगी और फिर क़बायलियों की आड़ में पाकिस्तान ने आक्रमण कर दिया। जब क़बायली बारामूला पहुँच गए और महाराजा के सैनिक कमज़ोर पड़ने लगे तब उन्होंने सहायता मांगी।

विलय की शर्त रखी गई, 26 अक्टूबर को महाराजा ने मेनन का लाया विलय पत्र साइन किया, 27 को डकोटा से भारतीय सेना पहुँची तो लाइट कट चुकी थी। शेख और उनके लोगों ने टॉर्च की रोशनी में सेना को उतारा।

महाराजा माल-मत्ता समेट के जम्मू चले गए।

अगले दो महीने लड़ाई चली। शेख ने हिंदुओं-मुसलमानों-सिखों को मिलाकर जनता की फ़ौज बनाई। मर्द-औरत सब। जनता शहर के अंदर क़बायलियों से लड़ रही थी, व्यवस्थाएं कर रही थी, सेना की मदद कर रही थी, सेना पाकिस्तानी सेना से लड़ रही थी। कभी मक़बूल शेरवानी की कहानी ढूँढ़ के पढ़िएगा।

महात्मा गांधी ने यह जानने पर कहा था- अगर शेख अब्दुल्लाह अपने सभी हिन्दू-मुस्लिम-सिख साथियों के साथ पाकिस्तान से लड़ते हुए शहीद भी हो गए तो मैं एक बूँद आँसू नहीं बहाऊँगा।

याद रखिएगा सैनिक हमारे बर्फ़ और पहाड़ पर लड़ने के लिए ट्रेंड नहीं थे, लेकिन लड़े और जम के लड़े। कश्मीर घाटी खाली कराई गई। पुंछ का एक हिस्सा खाली करवाया गया। कारगिल खाली करवाया गया।

फिर आया दिसम्बर। पाकिस्तानी ऊंचाई पर थे। लड़ाई मुश्किल हो रही थी। पटेल का एक पत्र है जिसमें वह लिखते हैं- अब और युद्ध खींच पाना संभव नहीं। लंबा चला तो अपने बहुत लोग मरेंगे और खज़ाना खाली हो जाएगा।

खैर दिसम्बर में समझौता हुआ। कश्मीर घाटी, जम्मू, पुंछ हमारे पास आया। मुजफ्फराबाद और थोड़ा सा इलाक़ा उधर रह गया। लाइन ऑफ सीज़फायर बनी।

जो ऊपर का हिस्सा है गिलगिट-बालटिस्तान, उसका कंट्रोल था 'गिलगिट स्काउट' के पास। इन चार्ज थे मेजर ब्राउन। तनख्वाह महाराजा से, काम अंग्रेज़ों का।

15 अगस्त को देश आज़ाद हुआ तो मेजर ब्राउन ने पाकिस्तान से एक तहसीलदार को बुलाकर सौंप दिया गिलगिट-बाल्टिस्तान। स्थानीय क़बीले सहमत थे ही।

महाराजा के ब्रिगेडियर घँसारा सिंह गिरफ़्तार हुए, बाद में भारत ने छुड़वाया।

मेजर ब्राउन को 'निशान-ए-पाकिस्तान' मिला बाद में, अंग्रेज़ रूस से लगने वाला इलाक़ा भारत को नहीं देना चाहते थे।

I hold the Hon’ble Vice President of India in great esteem, both for his wisdom and eloquence, but I respectfully disagree with his formulation.

The Supreme Court judgement putting Constitutional fetters on the power of Governors and President of India is timely, accurate, courageous and corrects the notion that ‘those holding high offices are above any fetters or imposition of checks and balances’ in exercise of their powers.

As a Citizen, student of law & as a Parliamentarian, my humble view is -:

1. In our democracy, only the Constitution of India is supreme and most elevated. No Office, be it of President or Prime Minister or Governor, is so elevated as to be above the fetters of Constitutional propriety.

2. Our democracy is founded upon the fundamental principle of ‘will of people’ expressed through elected Parliament and Legislatures. Hence, the highest bodies are the Parliament and Legislatures. Even their decisions and law making powers are subject to ‘judicial review’ by courts on the touchstone of Constitutionality.

Then, why should action of Governors and President of India be not subject to the same review, more so when Governors are mere nominees of Govt of India and President of India is elected by the same Parliament and Legislatures ?

3. Let’s test it on another hypothesis - Can the President be said to have unilateral or unchecked power to hold on to giving assent to the Laws passed by Parliament or Legislatures (vested by the Constitution to enact laws by majority mandate) for indefinite periods?

If President or Governors were to have such power, it will go against the very tenets of democracy for the elected Parliament and Legislatures will be rendered powerless and helpless.

The Constitution would never confer such unbridled powers in anyone, including the President of india.

The Office one holds, however high or elevated it may be, doesn’t make the Office immune from Constitutional control and adherence. Infact, the higher the Office, the higher the responsibility to be fair, transparent and accountable.

4. Judicial Independence is indeed a ‘nuclear missile’(to use Hon’ble VP’s words) to strike at injustice, arbitrariness, inequity, usurpation & assumption of power to subvert the Constitution and to defend the rights of people against arbitrary actions & decisions of those in power.

If the last door of justice was to close for ordinary people and justice becomes subservient to or gets dictated by the powers that are, democracy will die and dictatorship will prevail.

5. Finally, let us not forget two cardinal rules - (i) “WE, THE PEOPLE OF INDIA” are pre-eminent (Preamble to the Constitution), and (ii) India, that is Bharat, shall be a Union of States. (Article 1).

No one is above the Law or the Constitution, be it the President of India or any other authority.

The era of rulers and kings, who couldn’t be questioned, ended on 15th August, 1947 and once for all on 26th January, 1950, when the Constitution came into force. The President of India, in many ways, symbolises the end of monarchy and rule by the Constitution.

This being so, the President of India must come forward and salute the supremacy of the Constitution above all else.
