#Saharanpur_Mosque_Demolition: A Blow to Law and Justice
Jamiat Ulama-i-Hind central delegation visits Saharanpur, meets key stakeholders; resolves to pursue all legal avenues*
Saharanpur, Sept. 8, 2026: Jamiat president Maulana Mahmood Madani has expressed deep concern over the situation following the demolition of the historic Collectorate Mosque in Saharanpur. Acting on his special directions, a Jamiat Ulama-i-UP delegation visited Saharanpur on Monday. On Tuesday, a high-level central delegation of Jamiat Ulama-i-Hind, led by its General Secretary Maulana Muhammad Hakimuddin Qasmi, arrived in the city and reviewed the legal and social situation arising from the demolition.
The delegation met local residents, legal experts associated with the case, political figures and office-bearers of Jamiat Ulama-i-Hind, and held detailed consultations on the course of further legal action. It also met former MP Haji Fazlur Rahman, sitting MP Imran Masood, Firoz Khan, grandson of the late Yaqub Khan, Shah Haroon Khan, who is associated with the land in question, advocates Naushad Khan and Tanveer Ahmed, among others.
During these meetings, the circumstances surrounding the demolition, the conduct of the administration and the available legal remedies were discussed in detail. The legal team raised serious questions about the document reportedly relied upon as the basis of the judgment, stating that the document was not present in the judicial record and had not been formally placed on record. It was also pointed out that references to “Qaisar-e-Hind” or “Sarkar-e-Hind” cited in connection with the matter relate to a different khata and do not establish ownership over the disputed land.
The delegation subsequently held a detailed meeting with the lawyers to examine the various legal aspects of the case. Revenue records, historical documents relating to the mosque, claims concerning ownership and different aspects of the judicial proceedings were examined. The delegation said that a comprehensive and legally sound course of action was necessary to protect the rights of the affected parties. The possibility of approaching the higher courts and seeking appropriate legal relief is being worked out on the basis of available documents and records.
‘Every available legal avenue will be pursued’
Speaking to media persons, Jamiat Ulama-i-Hind General Secretary Maulana Muhammad Hakimuddin Qasmi said all relevant legal documents and evidence were being compiled and would be placed before Jamiat president Maulana Mahmood Asad Madani. The next course of action would be decided after consultation and legal advice.
Expressing deep anguish over the demolition, Maulana Qasmi said the manner in which the action was carried out, particularly the unusual haste shown by the administration, had caused considerable concern among residents and sections committed to justice.
“An affected party cannot be denied an opportunity to defend its rights and approach the courts before such drastic action is taken,” he said. “The right to approach a court is not a mere procedural formality. It is an essential part of constitutional justice. Administrative action should not be carried out in a manner that effectively closes the door for an affected party to seek relief from a higher court.”
Maulana Qasmi said the demolition had deeply saddened people across Saharanpur and should not be viewed merely through the prism of religion or community.
“This is not simply an issue concerning one religion or one community. It concerns the rule of law, constitutional rights and the basic principles of justice,” he said.
He said Jamiat Ulama-i-Hind had historically pursued questions of justice within the framework of the Constitution and the law and would continue to do so in the Saharanpur matter.
“We will knock on every available legal door. Wherever the people of Saharanpur require legal assistance in this matter, Jamiat Ulama-i-Hind will stand with them,” he said.

इतिहास गवाह है कि ज़ुल्म और नाइंसाफी कभी स्थायी नहीं रहे। जब ज़ुल्म अपनी इंतिहा को पहुँचता है तो इंसाफ की सुबह करीब आ जाती है। एक दिन ज़ुल्म व ज़बरदस्ती का अंत होगा, ज़ालिमों को अपने कर्मों का हिसाब देना होगा, और हमारा देश एक बार ���िर प्रेम, भाईचारे, न्याय, समानता और इंसानियत के रास्ते पर आगे बढ़ेगा।
हम एक जीवित (ज़िंदा) क़ौम हैं, और जीवित क़ौमें हालात के रहमो-करम पर नहीं रहतीं,वे अपने चरित्र, हौसले और अमल से हालात का रुख़ बदल देती हैं।

आज सहारनपुर कलेक्ट्रेट में बनी मस्जिद को भी अवैध बता कर बुलडोज़ कर दिया गया, सरकार को अगर 100 साल पुरानी बनी मस्जिदें भी अवैध लगती हैं तो फिर देश में सबकुछ ही अवैध है, विकास प्राधिकरण के गठन से पहले बना जौहर विश्वविद्यालय का निर्माण अवैध लगता है, कलेक्ट्���ेट बनने से पहले बनी अंग्रेज़ों के समय की मस्जिद अवैध लगती है, सरकार की नज़र में हर मुसलमान अवैध है, ये खेल कहॉं तक और कब तक चलेगा ??
अपने ही देश के नागरिकों और उनके धर्मस्थलों को अगर सरकारी साज़िश के साथ गिराया जायेगा तो कहने को क्या ही रह जायेगा।

Saharanpur Mosque Demolition: Jamiat Chief Questions Haste, Says Doors of Justice Were Shut
New Delhi, September 6, 2026: Jamiat Ulama-i-Hind president Maulana Mahmood Madani has strongly condemned the demolition of a century-old mosque on the Saharanpur Collectorate premises, describing the administration’s action as a serious blow to the principles of justice and due process.
Madani said the manner in which the demolition was carried out raised fundamental questions about the administration’s conduct. Since the dispute concerned land within the Collectorate premises, he said, the administration and the magistrate had themselves become parties to the matter. “It is a universally recognised principle of law that no party can be a judge in its own cause,” he said, adding that unilateral action in such circumstances amounted to a serious violation of the principles of justice.
Maulana Madani further said that the lower court’s order of September 4 contained no explicit direction for the immediate demolition of the mosque. Yet, within just a few hours, the administration proceeded to demolish the mosque in the night, without allowing the affected party sufficient time to pursue legal remedies or even obtain a certified copy of the court order.
He said a lower court’s decision cannot be treated as the final word when the law provides avenues of appeal before the higher judiciary. “The Constitution guarantees every citizen the right to approach the higher courts for relief. When an action can cause irreversible damage, denying the affected party even a reasonable opportunity to seek judicial intervention is deeply troubling,” Madani said.
He questioned the extraordinary haste with which the demolition was carried out, saying it had effectively left the affected party with little or no opportunity to seek relief from the higher judiciary. “When the consequences of an action are irreversible, the first responsibility of the authorities should be to ensure due process, not to rush through the demolition,” he said.
Maulana Madani urged the mosque committee and its legal advisers to approach the High Court without delay and seek appropriate judicial intervention. He said the action of the administration must be subjected to judicial scrutiny and that the rule of law must prevail over the arbitrary exercise of official authority.
In a broader appeal, Maulana Madani called upon all sections of society committed to justice, constitutional values and communal harmony to speak out against what he described as a growing pattern of arbitrary action against mosques and other places of worship. He said such actions cannot be viewed in isolation and warned that allowing them to continue unchecked could deepen communal divisions and undermine the country’s shared social and constitutional values.
The mosque in the Saharanpur Collectorate was demolished at 5 AM this morning.

The mosque committee produced records going back to 1911 to establish its existence. Prayers have been offered there continuously for more than a century. This is the very definition of waqf by user, which is still protected as waqf under law.
The Limitation Act does not ordinarily allow the Government an unlimited period to wake up one fine morning and assert possession over immovable property.
There was more than a century of open, continuous and public possession? The State cannot pretend that this possession began yesterday, hence the principle of adverse possession would apply even if we concede to the state’s arguments.
The mosque came first, the collectorate later.
For some people, perhaps the very sight of a masjid causes pain. That is their problem, not ours. Look away if you must. You cannot bulldoze our masjid just because you have an itch.

अमेरिका में एकता, भाईचारे और सभी धर्मों के सम्मान की बात करना स्वागत योग्य है, लेकिन इस संदेश की असली जरूरत आज भारत में है। यदि मोहन भागवत अपने इस विचार को वास्तव में अमल में लाना चाहते हैं, तो उन्हें न���रत फैलाने वालों से खुले तौर पर दूरी बनानी चाहिए और उनके खिलाफ प्रभावी कार्रवाई करके यह साबित करना चाहिए कि यह केवल विदेश में कही गई बात नहीं है।
भारत किसी एक धर्म का नहीं, बल्कि सभी धर्मों को मानने वालों का साझा वतन है। किसी भी विचार की सच्चाई भाषणों से नहीं, बल्कि उसके अमल से साबित होती है। इसलिए सवाल सीधा है—नफरत फैलाने वालों पर कार्रवाई कब होगी और संविधान में मिले समान अधिकारों की रक्षा जमीन पर कब दिखाई देगी?
