The 36th Amendment Bill would (i) remove Art 40.3.3 (8th Amendment) & (ii) insert 'Provision may be made by law for regulation of termination of pregnancy'.

The case referenced - Lavinia Doyle and Luca Chussi v. HSE settled. It concerned the interpretation of the Civil Liability Act. There was no judgment, and so we cannot comment on that argument in detail.

But it isn't something the law can really fix or so for us. And as I said it is the case already also. I hope this helps you w your question/concerns.

That would stay the same: but as abortion post viability will be a serious offence the emergency provision uses a double immediacy test to restrict abortion not a gestational limit.
