@CharlesFLehman I'm sorry, I should have waited for your further response. Isn't it possible to describe how property came to be? Does the distinction make more sense if I say the first statement is about "who has what" and the second is about "who should have what"?

@CharlesFLehman I would say people who have the power to exclude have property as a matter of fact — it's not an entitlement (if an entitlement is a normative claim on something). It's a description the real world.
