Underreported: A group of businesses and advertising lobbyists are pushing back on a new data privacy bill that could significantly impact their industry and give Americans more control over their data.
The American Privacy Rights Act (APRA), introduced by House Energy and Commerce Chair Cathy McMorris Rodgers, aims to allow Americans to opt out of targeted advertising, the right to view, correct, or delete their information, and the right to take civil action when their privacy rights are violated. The bill also seeks to become the law of the land and circumvent some states that may or may not have similar laws.
Congresswoman McMorris Rodgers has called the legislation an “opportunity for a reset,” adding, “It gives people the right to control their personal information online, something the American people overwhelmingly want. They’re tired of having their personal information abused for profit.”
Significant pushback:
Lobbyists and industry leaders argue that the bill would severely damage the advertising sector. Bob Liodice, CEO of the Association of National Advertisers (ANA), and Marla Kaplowitz, CEO of the American Association of Advertising Agencies, wrote in a letter that the bill “would eviscerate the modern advertising industry” and create an “extreme anti-consumer, anti-advertising, and anti-data privacy regime.” They also raised concerns about its constitutionality, stating that it would violate the First Amendment by restricting “truthful advertising” and said, “businesses have a right to speak, and consumers have a right to receive.”
Despite the opposition, supporters of the APRA argue that it is necessary to protect consumer data and curb the power of big tech companies. Kara Frederick of The Heritage Foundation’s Tech Policy Center said the bill would put an end to the pervasive surveillance and data harvesting.
