Articles 75 and 164 have been amended by
91st Constitutional Amendment Act, 2003
added Clauses (1A) and (1B) to both Article 75 and Article 164 to limit oversized cabinets and curb political opportunism
Capping Cabinet Size (Clause 1A): The total number of ministers, including the PM/CM, cannot exceed 15% of the total strength of the Lok Sabha (Article 75) or the State Legislative Assembly (Article 164).
Exception: For smaller states, Article 164(1A) mandates a minimum of 12 ministers.
Defection Penalty (Clause 1B):
Any MP or MLA disqualified under the Anti-Defection Law (Tenth Schedule) is automatically disqualified from being appointed as a minister. This restriction lasts until their term ends or they win a fresh election.
