Lawyers do not represent criminals! I need you people here to understand some basic rules of criminal cases:
1. The fact that someone is arrested for an offence does not mean they will be sent to jail immediately.
2. The Constitution, which is the supreme law of the law presumes anyone accused of any offence INNOCENT UNTIL PROVEN GUILTY. So unless the guilt of a person is proven, convicted and sentenced, you cannot label the person a criminal.
3. In criminal cases, the fact that an accused person confesses to the commission of a crime does not automatically mean he’s guilty and will be sent to jail immediately. The law does apply certain rules, especially due to possibility of the confession being obtained under duress, force or torture.
4. The burden of proof in criminal cases, as a general rule, rest solely on the state or prosecution, to prove the commission of a crime beyond reasonable doubt that no other person committed the offence except the defendant.
5. In cases where the punishment is death, even if the accused person confesses, pleads guilty or caught at the scene of the crime, the court must record not guilty, and call upon the prosecution to prove the case beyond reasonable doubt.
6. In criminal cases, any slightest doubt in the case of prosecution is resolved in favour of the accused person.
7. As a defence lawyer, even if your client confesses to you to have committed the crime, it’s not in your place to disclose to the court. Your job is to ensure that a fair trial is conducted.
8. As a constitutional right, every accused person has right to defend himself or through a lawyer of his choice. Where he cannot afford one, it’s the duty of the state to provide one for him, especially in capital offences. So on no occasion is someone allowed to face criminal trial without a lawyer except he expressly refuses the services of one.
9. Any criminal conviction on capital offences without a lawyer representing the accused, or on the basis of admission of guilt in court, without more is liable to be set aside.
10. Stop calling a lawyer representing anybody accused of a crime bad names simply because you don’t like the accused or the offence committed is too serious.
