If we, as a country, are going to uphold the rule of law, it should be the same for everyone. Here we have our president frequenting a shop run by an Ethiopian foreign national.
According to our law, what are the criteria for a foreign national to run a business in South Africa?
They need to procure a business visa, and this visa should only be extended to them according to them satisfying certain criteria:
– They must invest R5 million in order to be allowed to operate, certified by a chartered accountant.
– Their business must be registered through the Companies and Intellectual Properties Commission (CIPC).
– They must employ at least 60% South African nationals in the business, proof of which should be supplied to the Department of Labour within 12 months of registering.
– They must be registered for PAYE, UIF, COIDA, and any relevant Industry Sector Boards recognized by SAQA.
Has this man complied with all of these criteria? If not, why is the president of our country not saying something? This is not an issue about xenophobia. This is purely the law of our land.
While some might argue that the bureaucracy involved in setting up a business in South Africa is excessive, this does not indemnify one from having to be obedient to the law.
Personally, I think South Africans should be far more accepting of foreign small businesses. After all, small businesses are what create employment. But until the law changes, it is what it is.
