I wish to address your last point - the answer to which is long. It is inaccurate to say the President has not outlined the flaws in the report.
President Ramaphosa was represented at the Constitutional Court hearing. His legal team, along with counsel for the ANC and National Assembly (including Advocate Tembeka Ngcukaitobi appearing for the ANC), vigorously argued that the Section 89 Independent Panel report was fundamentally flawed.
Key flaws highlighted in court (including by Ngcukaitobi):
➡️The panel misconstrued its mandate and applied the wrong legal test.
➡️It conflated the standard for “sufficient evidence” with a prima facie case.
➡️The panel itself acknowledged gaps and insufficient information in places, yet still concluded there was prima facie evidence of serious misconduct/constitutional violations.
➡️The report made findings that went beyond the original motion.
These arguments were part of the defence that Parliament was rational in rejecting the report.
Important note: The ConCourt’s May 2026 judgment did not rule on the merits or validity of the panel report itself. It only dealt with Parliament’s process. That is precisely why Ramaphosa is now pursuing a full judicial review of the report - to have these flaws tested and adjudicated on their substance in court.
