Court is adjourned- towards the end, a Media Coalition lawyer (I didn't catch his name, he wasn't speaking into the mic), asked about when everything would be unsealed.
Carro confirmed the next virtual hearing will be August 11. He also addressed the sealing of the previous hearing, records etc, as the defense wasn't sure how they would move forward. Carro confirmed everything would be open to the press moving forward (once the transcript is redacted etc).
KFA says on the record, that she requested this be sealed because this defense is not available federally, and this could prejuidice the facts.
KFA brings up a Dateline episode that aired last week, citing bias and misinformation (I didn't catch all of it).
A virtual hearing will be set for mid-August
BREAKING: Judge Carro said he will unseal the defense's CPL 250.10 notice, which indicates the defense intends to present a psychiatric defense based on an alleged extreme emotional disturbance at the time of the offense. He also directed the defense to turn over any materials reviewed by its expert, including records and evaluations relied upon in forming their opinions. The notice was originally filed in September 2025, meaning the defense has had significant time to develop and support the claim. Carro noted that any expert-related disclosures should already be substantially complete. Before the documents are made public, the judge said the defense will be permitted to propose redactions to transcripts and other materials containing sensitive information. Seidemann now stood up to speak
Luigi Mangione was just produced by the court officers wearing a navy blue suit and light pink shirt. He's sitting in between Agnifilo (Marc) and Kaplan. There seem to be a lot of legal interns here, and I heard one of them gasp.
Defense has arrived- Karen F. Agnifilo, Marc Agnifilo, and Jacob Kapalan. Marc, as usual, making friendly small talk with court officers ( it was brief, though). Photographers and sketch artists are making their way through as well.
Back at 100 Centre Street for the Luigi Mangione hearing, take two. I arrived shortly before 9 a.m., and one of the court officers in the lobby told me that Mangione was already in the building and being held in the inmate holding area ahead of today's proceedings. Hopefully he is right! No lawyers or judge yet.
Both sides should be working on a questionnaire - Carro. JS says they’ve sent one over to counsel, waiting on reply. Carro says we can discuss tomorrow
Carro says both sides should be working on a jury questionnaire, with further discussion set for tomorrow. He also acknowledged a letter from the press and said he'll address it then. Court is adjourned until 9:30 a.m. tomorrow. Welp
Justice Carro: Come up to the bench.
[Whispered sidebar]
Justice Carro: Both sides should be working on a jury questionnaire
ADA: We were awaiting comments from [defense] counsel.
Justice Carro: See you tomorrow
10:09 am - Come to order!
Justice Carro takes the bench.
Luigi Mangione not here.
Justice Carro: Unfortunately the defendant could not be produced today. Do the People want to make a record?
ADA: Judge Garnett signed the order but it wasn't served. Tomorrow 9:30?
Carro just announced that Mangione will not be produced today. Seidemann said they produced a writ but it wasn't served to federal? He says they are available again at 9:30AM tomorrow. All attorneys are now at the bench
Unfortunately the defendant could not be produced today, no fault of this court. "It’s on us" we got the writ signed and failed to produce it. -JSeidemann
10:03 am - Justice Carro's courtroom deputy comes out - then NYS Court system's media man goes back into chambers with her. Might some written order be issued? If so, where? If the NYS courts had a system like PACER, even at 10 cents a page, might avoid this murk
