An Open Letter to @TwitchSupport@Twitch ,
The intent of this letter is to bring to your attention a unique situation where I am being ignored at best and downright mocked at worst by your customer support in the following ways:
- I cannot appeal
- I cannot get my tax forms
Explanation:
I am currently Indefinitely banned for "Inappropriate attire". First allow me to explain exactly how several attempts to get Twitch Support to help me has resulted in non-sensical responses:
1.- I cannot appeal my current ban. A website error "Something went wrong, please try again later" comes up in red letters every time I click the "Submit Appeal" button. I have attempted every browser, in regular and incognito mode. I have attempted 2 different PCs. And I have attempted MANY times for 22 days. I keep getting the same error.
I contacted Twitch Support with detailed information of all the troubleshooting steps I followed to try to submit my ban appeal. I am not looking for special treatment, I am simply wanting to be able to submit the appeal that, per their own TOS, I am entitled to.
Their response? A clearly botted response that basically said: "Okay cool but did you try appealing on our appeals portal? Here is the link."
I got this response THREE TIMES on 3 separate tickets, and 2 other tickets simply went unanswered.
2.- Since I am banned, I was unable to login to get my tax forms. Creating a ticket with Twitch support explaining this resulted in them telling me to login to get my tax forms, which AGAIN suggests a botted response that didn’t read my ticket.
For those not in the USA reading this, this should be understood. In the USA, streamers like me are legally considered contracted workers under Twitch. As such, Twitch is LEGALLY REQUIRED to provide me with a 1099 form, which denotates exactly how much money they paid me, which is also declared to the IRS by Twitch. They can legally be fined for not providing me with a 1099 form, which is exactly what they are doing here.
Because again, a banned person like me CANNOT log in into Amazon Tax Portal. And as I already stated, submitting a ticket for "tax request form" category resulted in non-sensical botted response "please login into the Amazon Tax Portal to get your tax forms"
At this point, you should be able to understand that I feel mocked. The answers are, to be perfectly honest, infuriating. I am not even being treated like a person. The requests on my submitted tickets are perfectly reasonable and yet, I have gotten zero attempts at actually being helped.
Being banned on Twitch took a big chunk of income that I depended on to meet my financial requirements to upkeep my household. And even then, I never looked for special treatment. Again, I simply wanted help with a website error, or my tax forms at least, but they weren't willing to do even that.
Now, Why was I banned? Let me explain what I know,because Twitch doesn't actually really tell you the "why" of a ban:
I am (was) KiyoXVR on twitch. I have been streaming on Twitch since April 9th of 2020. I am by no means a big creator, but I did amass a following of 4300 +, and a viewership that I was proud of 30 to 40 avg.
My platform and my community was focused on love, acceptance, and killing the demon that is loneliness. As a community open to all adults, we had a lot of LGBTQIA+ people, and many other people from different parts of the world and walks of life.
We never engaged in anything hateful. Trolls were simply dispatched with an immediate ban. I was careful not to let anything negative become significant during my streams. I worked very hard, thousands of hours, into making my channel a place that was comfortable for anyone 18+.
I never had issues with the platform through the majority of my time there. for about 3 years and 8 months of my time there, never had any bans or infractions or anything. But suddenly, something changed.
Starting in November of 2023, I started getting hit with bans despite making no changes to my content. Some of these, had zero context and some were even reversed without my action. I will list them:
1.- 7 day ban, Nov 28 2023 - Unsolicited Sexual Advances - The email was specific that it took place in someone else's chat. Within a day, when I was getting ready to appeal it, it had already been reversed. Without me doing anything. To this day, I have no context whatsoever of what or why this took place. I have never participated in anything that could even be remotely considered a sexual advance in somone's chat. And the fact that the ban was reversed without my action I guess means it was a mistake? I have no way of knowing.
2.- Warning, Jan 7 2024, Accidental Prohibited Content - The email was very vague and stated that I must have accidentally shown frontal nudity or some kind of nudity in some way. Let me state this very clearly: I have never once shown any kind of nudity in my stream. Artistic or otherwise. Period. Once again, Twitch deliberately leaves details out and I have no way of knowing why I was flagged for this.
3.- 1 day Suspension, Jan 19 2024, Inappropriate attire - In a suspension, Twitch points out the VOD with the infraction, but not a time stamp. During the clip for which this ban was issued, I was wearing swim wear. I was in a water environment, but apparently the context didn't matter here.
4.- 1 day Suspension, Jan 28 2024, Inappropriate attire - This is the first time I was banned while I was live. Since the last ban, I had avoided any camera angles that could be infractions, and I increased the obviousness of a beach/pool environment when wearing swim wear by actually being in the water, keeping the water visible, and making sure the swimsuit itself wasn't the focus of the stream. However, I still got hit.
After this suspension, I had a stream where I consulted with my chat,viewers of other VRC category streams, and I consulted in private with other streamers in my category my manager, and friends, as to what the best changes to make should be. The changes I made included:
- I discontinued any direct focus on booba or booty (even though this was supposedly allowed at the time as long as you are tagged for sexual themes)
- I discontinued my swimsuits
- I discontinued "booty" dancing or any lewd-leaning dancing.
However...
5.- Indefinite Suspension. Feb 18 2024, Inappropriate attire - This is the one that shocked me the most. I was very comfortable and confident that I had made more than enough changes to stay out of trouble, and when this ban hit me while I was live, I started crying, like a lost baby. My heart dropped and I plunged in Deep depression within 30 minutes. I appealed, and within 4 hours, I was able to get my channel back. I wore no swim suits during this stream. This stream featured a puzzle world in VRChat I was solving with my friends. If you asked me what triggered this ban, I could not tell you. I have absolutely no idea.
But after this, I decided that I didn't need to just do enough, but that I needed to exaggerate my approach. To go above and beyond what is expected. To become someone that takes the rules to what they and exaggerates them. And that’s what I did. Measures taken after this stream:
- Hired my 3d artist to put on leggings (with zero transparency) on ALL my models. So, simply ZERO booty even with a short skirt
- Discontinued ALL dancing from my stream, just to be on the safe side. Even non lewd.
- Discontinued not only swim wear but also beach worlds themselves, just in case the environment could be a trigger.
- Discontinued my dual view Scene in OBS, which was used to provide chat with a First Person View of exploration worlds, but I didn’t want to risk the view of my avatar to be misconstrued as booty or booba cam even accidentally.
- Discontinued any outfits with dangerous booba showage. Even if it was just cleavage, which is supposedly allowed.
- Completely rethought/redesigned my content to move away from ANY lewd focus whatsoever.
But, as you probably already guessed, this was not enough. And so..
6.- Indefinite Suspension, March 17th 2024, Inappropriate attire - Once again, I have no context. During the time I was banned while live in this stream, the camera was far from me, I was just sitting down, listening to a conversation from my friends. I have absolutely no way of knowing what triggered this ban. And even if an appeal was accepted, I have no idea on what else to change besides just...discontinuing VRChat streams ENTIRELY, if that seems to be issue, maybe? I really don't know. And Twitch won' tell me.
So WHY am I posting this public letter?
Despite the fact that I do not agree with the Ban, I'm not even looking for special treatment. I simply want my account fixed from the website error so that I can actually submit my appeal. And,I want someone in Twitch Support to reach out and provide me with my tax forms that they are LEGALLY bound to make available to me.
Closing thoughts- Please RT & Share for awareness. I think that it is important to point out that in many situations, Twitch is not demonstrating transparency nor care for their creators. Even if they don't intend to accept my appeal, they have no excuse for refusing to help me being able to submit it in the first place, nor refusing to help with my tax forms.
