9. Making a decision on the case within 30 days:
Under Article 18 (Deciding on the Case) the circuit will come to a decision within 30 days from the first session and may extend it no further than 15 days, where required.
8. The plaintiff may respond to the defendant's memorandum within 10 days:
Under Article 14 (Exchange of memorandums) the response period provided to the plaintiff on the defendant’s memorandum is 10 days from the date of notification. In the event of no response, the Secretariat shall review the case and refer it to the competent circuit.
7. A new means of communication:
Under Article 12 (Means of Communications) a new means of communication is added and includes a notification to the address recorded in the commercial registry.
6. Retraction of the decision after pronouncing but before delivering to the parties:
Under Article 29 (Correcting the Decision) the circuit may retract its decision after pronouncing but before delivering it to the parties without pleading when a need arises for that, provided that the reasons for doing so are recorded in the minutes of the session.
5. One objection per each lawsuit:
Under Article 11(Lawsuit submission mechanism and information) each objection should be addressed with a separate lawsuit.
4. Expansion of the jurisdiction of the circuits:
Under Article (3) the jurisdiction and grievance procedure is expanded to include the public rights claim. Additionally, the Committees have been granted the authority to impose penalties.
3. The definition of a taxpayer includes a person subject to customs duties The definition of a taxpayer in Article 1 (Definitions) includes a natural or legal person subject to Zakat, tax, and/or customs duties in accordance with the Zakat, tax, and customs laws and regulations.
2. Removal of the territorial jurisdiction restriction of the circuits except for customs smuggling cases and the like
Under Article 4 (Territorial Jurisdiction) the territorial jurisdiction restriction of the circuits has been removed, meaning that the relevant circuits may handle any lawsuit even if the litigants are registered in different cities, except for customs smuggling cases and the like that will be heard in the territorial jurisdiction where the crime was committed.
1. The working rules apply to Custom Committees
The working rules which are presented in 51 articles in11 sections apply to Custom Committees, in addition to the Tax and Zakat Committees.
New Working Rules for Zakat, Tax and Customs Committees
New working rules for the Zakat, Tax, and Customs Committees (GSTC) have been approved, through the Royal Order No. 25711 dated 23 October 2023. These rules are enforceable as of the order’s publication in the Official Gazette (Umm Al Qura) on 27 October 2023, replacing the previous rules under Royal Decree No. 26040.
Below is a summary of the key changes:
٩. الفصل في الدعوى خلال (ثلاثين) يوماً
نصت المادة الثامنة عشرة (الفصل في الدعوى) على أن تفصل الدائرة في الدعوى المعروضة أمامها خلال (ثلاثين) يوماً من تاريخ انعقاد أول جلسة فيها، وللدائرة -في الحالات التي تستدعي مدةً أطول- أن تمدد المدة بما لا يتجاوز (خمسة عشر) يوماً أخرى.
٨. للمدعي الاطلاع على رد المدعى عليه خلال (عشرة) أيام من تاريخ الإشعار
نصت المادة الرابعة عشرة (تبادل المذكرات) على أنه للمدعي الاطلاع على رد المدعى عليه خلال (عشرة) أيام من تاريخ التبليغ برد المدعى عليه، وإذا لم يودِع الرد خلال المدة المقررة تدرس الأمانة الدعوى وتحيلها إلى الدائرة المختصة.
٦. العدول عن القرار قبل تسليمه لأطراف الدعوى
نصت المادة التاسعة والعشرون (تصحيح القرار) على أنه للدائرة من تلقاء نفسها العدول عن قرارها بعد صدوره، وقبل تسليمه أطراف الدعوى، من غير مرافعة عند ظهور مقتضى لذلك، على أن تدون أسباب ذلك في محضر الجلسة.
٥. اعتراض واحد في صحيفة الدعوى
نصت المادة الحادية عشرة (آلية رفع الدعوى وبياناتها) على أنه لا يجمع في صحيفة الدعوى بين أكثر من اعتراض لدى الهيئة، وتقيَّد دعوى مستقلة لكل اعتراض.
٣. توسيع تعريف المكلف ليشمل الشخص الخاضع للرسوم الجمركية
تضمن تعريف "المكلف" في المادة الأولى (تعريفات) الشخص الخاضع للرسوم الجمركية حيث جاء تعريف المكلف بأنه كل شخص طبيعي أو اعتباري خاضع للزكاة و/أو الضريبة و/أو الرسوم الجمركية، بمقتضى الأنظمة واللوائح الزكوية والضريبية والجمركية.
٢. إلغاء الاختصاص المكاني للدوائر باستثناء دعاوى جرائم التهريب الجمركي وما في حكمه
نصت المادة الرابعة (الاختصاص المكاني) على أنه يجوز أن تُنظر الدعوى في أي دائرة مختصة نوعياً بنظرها دون التقيد بالاختصاص المكاني لها، ويستثنى من ذلك دعاوى جرائم التهريب الجمركي وما في حكمه، والشروع في أي منها، بحيث ينعقد الاختصاص المكاني للدوائر الداخل ضمن اختصاصها المكاني مكان ارتكاب الجريمة.
