๐๐ฝThe problem with some in power today, they forget that loyalty ends where abuse begins.
๐๐ฝIf the AFP dares to remove the pensions of retired soldiers just because they speak against the leadership or the President, that would be a direct assault on the 1987 Constitution itself. โ๏ธ
๐ฉUnder Article III, Section 4, every Filipinos, even a retired soldier, has the right to free speech and expression. Once you hang your uniform, you return to being a civilian with full constitutional rights. You cannot be silenced for having an opinion.
๐ฉ๐ฉPensions are not a privilege, they are a vested right earned through years of service and sacrifice.
๐ฉAs ruled by the Supreme Court in Republic v. Sandiganbayan (G.R. No. 152154, July 15, 2003), pension benefits are property rights protected by due process and the non-impairment clause (Article III, Section 10). They cannot be taken away without lawful cause.
๐ฉEven Republic Act No. 340, Presidential Decree No. 1638, and Republic Act No. 7077 guarantee that military retirement pay is for life, unless forfeited due to a valid criminal conviction or dishonorable separation while still in service, not for political opinions expressed after retirement.
Retired soldiers are citizen, not subjects.
To suppress their voice is to betray the very oath they once swore to defend:
