Relying on the decision of the Court of Appeal in His Highness the Kabaka of Buganda v Kibuule Ronald & Another, Civil Appeal No. 369 of 2021, where the Court โโThe parties have not filed their submissions to date. In the absence of submissions, there is no basis and guidance on which the Court may make a decision on this Appeal.
The failure of the parties to file submissions signifies that they were no longer interested in prosecuting their appeal.
An Appeal can only be determined upon parties arguing the grounds of the Appeal by pointing out the decisions of the lower Court they are aggrieved with. These issues can only be responded to in their totality after parties guide the Court through their submissions in line with the remedies sought and the law.โ (Emphasis added.)
