Qualcosa, in questo Paese, si è gravemente inceppato. Capovolto. Stravolto.
Perché non è normale che un organo come la magistratura, che dovrebbe essere apolitico, indipendente, ispirato a equilibrio, razionalità, decoro e sobrietà, festeggi l’esito di un referendum come se fosse allo stadio, e non dentro una procura.
Qui il moralismo non c’entra nulla. C’entra il rispetto della separazione dei poteri. Quella stessa separazione che queste persone, che ora brindano e cantano “Bella Ciao”, hanno detto di volere difendere votando NO.
Festeggiano cosa? La conservazione della separazione dei poteri, che nessuno minacciava, o la conservazione di equilibri interni, di correnti politicizzate, di giochi di potere, di dinamiche che nulla hanno a che vedere con la giustizia?
E il paradosso è tutto qui: a subirne le conseguenze saranno proprio quei magistrati che la toga la indossano per servire i cittadini, non per fare politica. Onore a loro.

1. HEARING BATTLE WON today in NV 8th Judicial District Court (DC) attorney Jeffrey Haber got a huge win. The court basically granted everything we requested. Michael Hamrick was allowed to intervene, he was appointed by the court as custodian of Vinco Ventures and Liqueous was ordered to be removed as custodian. This validates that we were correct about our rights of shareholders and the fraudulent activity alleged.

As a $BBIG shareholder I am saddened to find out that Mamadou dropped his case. Though as someone who bought and downloaded the court reporter’s minutes after each hearing, I understand why he felt that he had to.

If you put all your faith in shareholder justice into this case and are sad that Cap’n is ending his Tuesday calls, please don’t let this affect you. There are massive opportunities remaining with the Hamrick/Martineu matter as they seek damages from the board of directors AND hedge funds, as well as continuing to pursue custodianship from Liqueous. In conjunction with impending DOJ updates, I am incredibly excited for what can still happen.

Truth is, I haven’t felt comfortable participating in the weekly Tuesday BBIG calls for several months. In listening to the recordings each week, I have felt these served more as propaganda to spin particular narratives. I do not feel it would have been beneficial or helpful to argue with folks when I felt they were not being transparent or were putting out misinformation. @RetailRudy has never wavered on his commitment to support the community in whatever capacity he can. Attacks on his character will prove foolish.

I appreciate Akoum for the effort he put into his case, I know the amount of work and cost that went into it had to be overwhelming. Regardless of the outcome, there are several positive impacts from this case that I hope can be building blocks for future litigation. As a community, let’s unite and rally around the existing derivative suits that can still benefit all of us. Let’s collaborate, discuss facts, and share positive vibes. Let’s get back to realizing there’s only one team.

Several international shareholders of $BBIG have received a response from VAF (victim assistance fund).

I've been trying to tell people this. It doesn't matter if you're from the US or not. If you're able to trade on a US stock exchange and you were a victim of fraud you're a victim. No legal advice but I will give my opinion.

I don't know why people eliminate themselves. You have nothing to lose sending in the victim impact statement in the first place, but don't limit yourself because you're overseas. Worst case scenario they say no. But we've already have proof now that they're not saying no. They're hearing your questions and who knows maybe we'll get some restitution besides accountability.

I certainly hope so.
