On 11 July 1996, the Ranvir Sena attacked a Dalit settlement at Bathani Tola, Bihar, setting it ablaze and killing 21 Dalits, including three infants, six children, eleven women, and one man. The Ranvir Sena was predominantly composed of members of the Bhumihar caste.

The Ara District and Sessions Court convicted the accused, sentencing three to death and twenty to life imprisonment. In 2012, however, a Division Bench of the Patna High Court, comprising Judges Navaniti Prasad Singh and Ashwini Kumar Singh, acquitted all 23 convicts.

The case has remained pending before the Supreme Court since 2012. Thirty years after the massacre, the victims and their families remain without final justice. Fourteen years of pendency before the Supreme Court, in a case involving the killing of 21 Dalits, raises profound concerns about institutional prejudice against Dalits within the judiciary.

It has been three days since Chirag Paswan's party filed a complaint against Hindutva goon Swatantra Bhardwaj, but the Delhi Police has still not registered an FIR. Why?

Experience tells me that police investigations are deliberately faulty and courts are very casteist and hostile towards SC/ST cases. That is why the conviction rate is abysmally low.

I came across an SC/ST case where the police filed a closure report despite an eyewitness being available. The complainant filed a protest petition, paid a huge fee to a leading lawyer, and won it. Later, a chargesheet was filed. The accused then filed a quashing petition in the High Court, which granted an ex parte stay.

In this case, the IO did not arrest the accused, issued a Section 41A notice, and recorded Section 161 statements from witnesses who had not witnessed anything. But the complainant was repeatedly summoned and harassed.
