Suspended Nairobi Finance CEC Charles Kerich has suffered another legal setback after the High Court declined to suspend his three-month civil jail sentence.
Kerich had asked the court to halt the sentence, arguing that he is undergoing specialist medical treatment in the United States and is too ill to return to Kenya. The court was not persuaded, marking the fourth time he has sought relief from the order.
@gitweeta The ruling leaves several pertinent questions unanswered. Although it affirms that IFIs enjoy broad immunity, it fails to examine the well-established exceptions to such immunity recognized in international jurisprudence.

Justices Francis Gikonyo,Moses Ado and Roselyne Aburili have today ruled that the International Monetary Fund (IMF) @IMFNews enjoys absolute immunity from judicial proceedings in Kenyan courts, unless that immunity is expressly waived.

Today, the High Court is set to rule on several issues in the Odious Debt Petition, including the IMF's claim to judicial immunity. Our Centre for Legal Aid and Clinical Legal Education (CLACLE) is participating in the matter as amicus curiae.
