The next IPRWA we will look at is the sound recording, or โphonorecordโ copyright.
This copyright represents the sonic embodiment of the publishing rights discussed last week. For instance, Lennon-McCartney (ok, Paul) wrote Let It Be, but if I record (and pay for) a new version of it, I will own the copyright to the new recording. I will need permission to use the song in the recording (which under US law is effectively automatic after the song is first released), but I own the recording. And so would you, if you paid for a new recording of Let It Be.
So the sound recording copyright is separate from the publishing, with similar reproduction, distribution, public performance, and derivative rights as the publishing. A record label generally owns and distributes the sound recording, and pays a royalty to the artist and the producer/mixer of the sound recording.
And yes, $APL is credited with some sound recording copyright royalties, including for Peaches, everytime that recording is streamed, sold, or included in film, television or commercials.
